THE REAL FASHION BY R.M. LUXURY ITEMS BUYING SERVICES

(Terms and Conditions)

 

DEFINITIONS

1. “You” or “Seller” - the person or entity that submits an item to sell  to us (“The Real Fashion by RM”).

2. “Us” or “We” -  refers to “The Real Fashion by RM” and/or its authorized representative.

3. “Quote” – is the quote provided by Us after the seller submits pictures and description to our website.

4. “Final Quote” – is the quote provided by Us after we received the actual item and after reasonable our inspection and authentication.

5. “Revised Quote”—refers to quote if The Real Fashion by R.M. determines, at its discretion, that your Item is authentic but not in the condition described in your submission or if accessories that are ordinarily an accessory or part (i.e. strapped, locks) of the Item (without stating in the submission)  are not shipped

6. “Item” - refers to bags, wallets, purses or any other luxury accessories submitted by You to sell to The Real Fashion by R.M..

1. SELLER’S REPRESENTATIONS
 

1. BY AVAILING OUR BUYING SERVICES, YOU ACCEPT AND AGREE TO ALL THE FOLLOWING TERMS AND CONDITIONS.

2. YOU  ALSO REPRESENT THAT YOU ARE COMPETENT TO ENTER INTO AND AGREE TO THESE TERMS AND CONDITIONS.

3. YOU REPRESENT AND WARRANT THAT YOU HAVE THE LEGAL TITLE TO THE ITEM YOU ARE SUBMITTING TO US OR YOU HAVE THE LEGAL AUTHORITY TO SELL ON BEHALF OF AN ENTITY.

4. ANY SALE OF ITEM TO “THE REAL FASHION BY R.M. IS VOID IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS.

5. YOU WARRANT THAT ANY ITEM YOU SUBMIT TO SELL TO THE REAL FASHION BY R.M. IS AUTHENTIC.

2. SUBMITTING AN ITEM TO SELL

1. You will submit descriptions of the Item/s to the email on “The Real Fashion by R.M” website https://www.therealfashionbyrm.com/ , “Buying Services” page. 

2. You will then send pictures of the Item to therealfashionbyrm@yahoo.com. You should submit a minimum of eight (8) pictures of each of the Item/s you intend to sell.

3. After receiving your submission, we will review the description and the pictures you submitted. We may require you to submit additional pictures or provide more description.

4. If We determine, at our sole discretion, that your Item is acceptable, we will send you an Initial Quote. If we do not intend to buy your Item based on your submission, we will inform you of our decision within reasonable time.

5. If you accept the Initial Quote, you will send your Item by mail or any courier to The Real Fashion by RM for inspection and assessment.

6. After receiving your Item, we will inspect the item and provide you with Final Quote by email. If the Item is determined to be authentic and consistent with the description and with parts and accessories mentioned in the submission the Initial Quote may be the Final Quote after we confirm it by email.

7. Final Quote is valid for thirty (30) days from the date we sent you the Final Quote. The Final Quote will then expire automatically. Once a quote has expired, you may resubmit an Item for a new quote. The same process described above will apply.

8. You should not submit the same item more than one time in a 30-day period. If you submit more than once, the lowest of the quotes will apply.

 

3. INSPECTION OF ITEMS

1. We will inspect and review the Item to confirm its authenticity after receiving it from you. You understand that we cannot assess the authenticity based on the pictures or description you submitted online.

2. The inspection is to confirm the Item’s authenticity and to check if the condition is consistent with the description submitted to our website

   1. Not Authentic. If we determine that your Item is not authentic. We will NOT proceed with the buying process and your item will be returned you with applicable charges stated in Sec 4(a), Cancellation Process.

   2. Authentic and Consistent Description. If we determined that your Item is authentic and it is accurately described in your submission, we will send you payment as mentioned in the Initial Quote. This will be full payment of your Item.

   3. Not Accurately Described. If we determine, at our discretion, that your Item is authentic but not in the condition described in your submission, we will provide you with a Revised Quote. We will also issue you Revised Quote if accessories (i.e. straps, locks and keys, pouchettes) that are ordinarily an accessory or part of the Item but not shipped. If you accept our Revised Quote, then we will issue payment to you for the Revised Quote.

   4. Return of Item. If you reject the Revised Quote, then will return the Item to you and provide you with mailing tracking number, but you agree to bear the risk of loss. You also agree to pay for the return shipping cost.

3. You represent and warrant that the Item/s you submit to sell to Us is authentic. Our determination, at our sole discretion, that an Item is NOT authentic is final and conclusive. 

4. Issuance of payment by The Real Fashion by R.M. for any Item is not evidence or admission of authenticity. Even after payment, if the Item is determined to be not authentic or counterfeit, we have the right to cancel the sale and you agree to return all funds issued to you by Us. You agree to your duties as stated in Sec. 4(a), Cancellation Process.

 

4. CANCELLATION PROCESS AND FEES

1. All sales are considered final at the time of sale. Nonetheless, if any Item is found to be a counterfeit or not authentic, we will return the Item to you and the you agree to the following:

1. You immediately refund to Us any and all payments issued to you for such Items.

2. (c) You pay to Us a Cancellation Fee of  US$50.00

3.  You agree to pay for the shipping costs

4. You agree to bear the risk of loss.

1. We will also agree to cancel the sale if you request Us to return your Item provided that:

   1. Item is not sold

   2. You immediately refund to Us any and all payments issued to you for such Items.

   3. You pay to Us a Cancellation Fee of US $50.00

   4. You agree to pay for the shipping costs

   5. You agree to bear the risk of loss.

2. You acknowledged and agree that if Items for which any Cancellation Fee has been left unpaid for sixty (60) days from cancellation, we have the right to destroy or dispose the item at our discretion.

3. We reserve the right to take any action permitted under the law  recover any costs incurred by in connection with your submission of unauthentic Items, including but not limited to retaining any of your other Items or referring your duty to pay to a collections agency.

 

Limitations of Liability. You agree that any liability of The Real Fashion by R.M. and its representatives is limited to the value of the item. You agree not claim any consequential, liquidated  or any other damages.

5. PRICING AND QUOTES

1. We reserve the right to determine pricing and Quotes for all Items based on our reasonable discretion and may be based on comparable prices for items of the similar style and condition.

2. Determination of the price or providing a quote for an Item is not a guarantee of pricing or quote for another item.

3. The Real Fashion by R.M. may, at any time, revise or change the pricing, its basis and factors considered

 

6. RECEIVING PAYMENT

1. It is your duty to maintain the payment method you submitted for the purpose of completing the transaction contemplated in these terms and conditions. You acknowledge and guarantee that you can and will receive payment from the payment method you provided.

2. You warrant that all information you have given for your payment method, including, without limitation, credit card, debit card, PayPal, or other payment information, is accurate, current and complete.

3. You represent and warrant that you have the legal right to use the payment method you provided in completing the transaction in this agreement.

4. You acknowledge and represent that once the payment is completed in the payment method your provided, you received full and final payment of your item.

5. Subject to other applicable provisions of herein terms and conditions, we will issue payment for the Item once:

   1. We have received, assessed and authenticated the Item, and;

   2. You have accepted our Final Quote or the Revised Quote made after we inspect the Item, if applicable.

6. Payment methods include, including but not limited to: Paypal, wire transfer, direct deposit, check, or store credit. Store credit payments will enjoy an additional 12% bonus in value.

7. You may change your payment method at any time; however, changes will apply to future payments only. Once payment is initiated Payment methods cannot be changed for payments that have already been initiated.

 

7. EFFECTIVE DATE

These terms and conditions will be effective upon your submission of any Sale Item to The Real Fashion website. As applicable, it will continue to be effective as it is applicable to the sale of Item/s.

 

8. GENERAL TERMS

1. We may modify the terms and conditions at any time. You must check and review these terms and conditions every time you submit an Item to sell to The Real Fashion by R.M.

2. If we make material changes, we may attempt give you notice by email or prominent notice on our website. However, it is your sole responsibility to review these terms and conditions from time to time to view any such changes. Your continued  use of our Buying Services  after the changes have become effective will be deemed your conclusive acceptance of the modified terms and conditions.

3. If you do not agree with these terms and conditions, please do not use our  Buying Services.

4. Modifications become effective immediately when published on The Real Fashion by R.M. website

5. If we believe you are violating or breach any of these terms and condition, you may be subject to restrictions of your use of our services and/or website or claim for cost including but not limited to suspension of your account, claim for damages or costs.

 

Disputes. You agree that these terms and conditions will govern any dispute between you and  The Real Fashion by R.M.  This agreement is governed by laws of California.
